1. Acceptance of Terms
By accessing or using Radahost services, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any other policies referenced herein. If you do not agree, please discontinue use of our services.
2. Services Provided
Radahost offers:
- Web hosting
- Domain registration
- Website design
- Search engine optimization (SEO)
- Social media management
- Related digital services
All services are provided on an “as is” and “as available” basis, subject to our Service Level Agreement (SLA).
3. Payment and Billing
- Non-Subscription Services (e.g., web design, development): 50% upfront before commencement, and 50% upon completion and client satisfaction.
- Subscription Services (e.g., hosting, SEO, social media): 100% upfront payment before service activation.
- Late Payments: Overdue accounts may be suspended until cleared. Continued non-payment may result in termination and data loss.
- Refunds: Subscription services are non-refundable once activated. Refunds for projects are discretionary and subject to review.
4. User Responsibilities
Clients must:
- Provide accurate and up-to-date information.
- Keep account credentials secure.
- Use services in compliance with laws and Radahost’s Acceptable Use Policy (AUP).
- Refrain from illegal, abusive, or harmful activities.
5. Domain Registration and Renewals
- Domain availability cannot be guaranteed until registration is complete.
- Clients are responsible for timely domain renewals.
- Radahost is not liable for losses caused by expired domains.
6. Service Suspension and Termination
Radahost may suspend or terminate accounts for:
- Non-payment
- Breach of these Terms or the AUP
- Illegal or malicious activity
Upon termination, all client data may be permanently deleted.
7. Service Availability
We strive to provide reliable uptime as per our SLA but do not guarantee 100% availability. Scheduled maintenance and unforeseen outages may occur.
8. Limitation of Liability
Radahost shall not be liable for indirect, incidental, or consequential damages, including data loss, business interruption, or lost profits.
Our liability is limited to fees paid within the 12 months preceding a claim.
Service Level Agreement (SLA)
1. Uptime Commitment
Radahost strives to provide reliable hosting services with 99.9% uptime per calendar month.
This excludes:
- Scheduled maintenance
- Emergency maintenance
- Circumstances beyond our reasonable control (force majeure, provider failures, DDoS attacks, etc.)
2. Scheduled Maintenance
- Performed periodically to ensure optimal performance.
- Clients will be notified in advance whenever possible.
- Scheduled maintenance is not counted as downtime.
3. Emergency Maintenance
- May occur without prior notice (e.g., for security vulnerabilities or active attacks).
- Temporary downtime may result, but efforts will be made to minimize disruption.
4. Exclusions
This SLA does not apply to:
- Client-side errors, misuse, or misconfiguration
- Third-party applications or integrations
- Suspension/termination due to non-payment or AUP violations
- Factors beyond Radahost’s reasonable control
5. SLA Credits
- If uptime falls below 99.9% in a given month, clients may request up to 5% credit of their monthly hosting fee per downtime hour, capped at 100% of the monthly fee.
- Requests must be submitted to [email protected] within 7 days of the downtime.
- SLA credits are non-cash and may only be applied to future invoices.
9. Intellectual Property
All trademarks, content, and materials provided by Radahost are protected intellectual property. Unauthorized reproduction or use is prohibited.
10. Governing Law
These Terms are governed by the laws of Kenya.
Disputes shall be resolved through mediation or Kenyan courts.
